These Terms & Conditions (“Terms”) govern your access to and use of PyUltra Bulk Mailer Pro (the “App”) and the website jmktechnologies.co.in (the “Site”), operated by JMK Technologies (“we”, “our”, “us”). By using the Site or App, you agree to these Terms.

1) Eligibility & Account

You must be legally capable of entering into a binding agreement to use the Site/App.
You agree to provide accurate information and keep your credentials confidential.
We may limit simultaneous devices per account as shown at purchase time and in your plan.
You are responsible for all activity under your account and devices registered to it.

2) License & Scope of Use

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App solely for lawful business purposes and in accordance with your plan limits.
Except as permitted by law, you may not reverse engineer, decompile, or circumvent technical protections.
You may not rent, lease, resell, sublicense, or share access to the App or your account.

3) Acceptable Use & Anti-Spam

You must comply with all applicable laws and regulations, including anti-spam and privacy laws (e.g., consent/opt-out requirements under CAN-SPAM, GDPR/ePrivacy, or local equivalents).
Unsolicited bulk email (spam) is strictly prohibited. You must have verifiable consent or a lawful basis to message each recipient.
You must honor unsubscribe requests promptly and include accurate sender identity and contact information in emails where required by law.
Do not send content that is illegal, hateful, abusive, deceptive, malware-related, or that infringes third-party rights.
You are responsible for your sender reputation, DNS configuration (SPF/DKIM/DMARC), IP/domain warm-up, and rate controls appropriate to your infrastructure.
If you use open/click tracking, you are solely responsible for obtaining any legally required consent from recipients.

4) No Guarantee of Inbox Placement

Email deliverability depends on factors outside our control (recipient servers, ISP policies, sender/domain reputation, content, and third-party filters). We do not guarantee inbox placement, delivery rates, or any specific outcomes.

5) Plans, Limits & Devices

Your plan includes usage limits (e.g., SMTP/API send limits) and an allowance for devices that can use the App simultaneously.
We may display usage to you and enforce limits via the App or our API. Attempting to circumvent limits is prohibited.
We may suspend or terminate accounts that exceed limits repeatedly or violate these Terms.

6) Payments, Taxes & Refunds

Paid plans are charged via third-party gateways (e.g., PayPal, PhonePe). You authorize the processor to charge your selected payment method.
Prices may exclude applicable taxes; any taxes, conversion, or bank fees are your responsibility.
Because the App is digitally delivered and accessible immediately after purchase, payments are non-refundable except as described in our Refund Policy.
Plans are term-based. Unless otherwise stated, auto-renew is not enabled; you can manually renew before or after expiry.

7) Delivery & Activation

After successful payment, the download link and activation details are issued to your registered email.
You must keep your credentials secure and not share them.

8) Updates & Changes to the App

The App may check for updates and, with your consent, download and install them. Updates may fix bugs, improve performance, or change features.
We may modify or discontinue features at any time with or without notice. Where feasible, we will maintain backward compatibility.

9) Third-Party Services

The Site/App may integrate or link to third-party services (payment gateways, email providers, analytics). Your use of such services is governed by their terms and privacy policies. We are not responsible for third-party services.

10) Intellectual Property

The App, Site, and all related content are owned by JMK Technologies or its licensors and are protected by intellectual property laws.
Trademarks, logos, and product names are the property of their respective owners and may not be used without permission.

11) Privacy

Your use of the Site/App is also governed by our Privacy Policy. We do not store your full card/UPI/bank details; payments are processed by third-party gateways.

12) Suspension & Termination

We may suspend or terminate your access immediately if you violate these Terms, applicable laws, or our anti-spam requirements, or if your account is used for abuse.
Upon termination, your license ends and access to the App may be disabled. Sections intended to survive (e.g., IP, disclaimers, liability) will survive.

13) Disclaimers

The Site/App are provided “as is” and “as available” without warranties of any kind, express or implied.
We do not warrant uninterrupted or error-free operation, or compatibility with your environment.
No advice or information creates any warranty not expressly stated in these Terms.

14) Limitation of Liability

To the maximum extent permitted by law, JMK Technologies shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business interruption, arising from or related to your use of the Site/App, even if advised of the possibility of such damages.

15) Indemnification

You agree to indemnify, defend, and hold harmless JMK Technologies and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Site/App, your violation of these Terms, or your violation of any law or third-party rights (including anti-spam and privacy laws).

16) Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the courts located in India for any dispute arising out of or relating to these Terms or the Site/App.

17) Changes to Terms

We may update these Terms from time to time. The “Last updated” date above indicates the latest version. Continued use of the Site/App after changes means you accept the updated Terms.
